Terms and conditions

These terms and conditions (“Agreement”) set forth the general terms and conditions of your use of the www.websitecategorizationapi.com website (“Website” or “Service”) and any of its related products and services (collectively, “Services”).

This Agreement is legally binding between you (“User”, “you” or “your”) and Alpha Quantum, d.o.o. (doing business as “Alpha Quantum”, “we”, “us” or “our”).

If you are entering into this agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this agreement, in which case the terms “User”, “you” or “your” shall refer to such entity.

If you do not have such authority, or if you do not agree with the terms of this agreement, you must not accept this agreement and may not access and use the Website and Services.

By accessing and using the Website and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. You acknowledge that this Agreement is a contract between you and Alpha Quantum, even though it is electronic and is not physically signed by you, and it governs your use of the Website and Services.

Prohibited uses

In addition to other terms as set forth in the Agreement, you are prohibited from using the Website and Services for any of the following purposes:

• To reverse engineer, decompile, disassemble, or attempt to derive the source code, underlying algorithms, categorization logic, confidence scoring methodology, taxonomy mapping methodology, SNI classification logic, or any other proprietary component of the Website and Services, whether through systematic querying, automated scraping, sampling, or any other means.
• To use any information, data, results, outputs, or materials obtained through the Website and Services for competitive analysis, competitive intelligence, competitive benchmarking, feature comparison, pricing intelligence, or any purpose intended to inform, develop, improve, train, or support a competing product, service, or business.
• To access or use the Website and Services on behalf of, at the direction of, or for the benefit of any direct or indirect competitor of Alpha Quantum, as defined in Section 6 (Competitor Access Prohibition) of this Agreement.
• To register, create an account, or obtain access to the Website and Services under a false identity, using anonymized or disposable email addresses, or by misrepresenting your organizational affiliation, employer, intended use case, or any other material information.
• To systematically query, download, or harvest data from the Website and Services in a manner designed to replicate, reconstruct, or approximate Alpha Quantum's proprietary databases, category assignments, or classification outputs.

Further, you are prohibited from using the Website and Services:

(a) for any unlawful purpose;
(b) to solicit others to perform or participate in any unlawful acts;
(c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances;
(d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others;
(e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
(f) to submit false or misleading information;
(g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Website and Services, third party products and services, or the Internet;
(h) to spam, phish, pharm, pretext, spider, crawl, or scrape;
(i) for any obscene or immoral purpose;
(j) to interfere with or circumvent the security features of the Website and Services, third party products and services, or the Internet.

We reserve the right to terminate your use of the Website and Services for violating any of the prohibited uses.

Accounts and membership

If you create an account on the Website, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it.

You must immediately notify us of any unauthorized uses of your account or any other breaches of security.

We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.

We may suspend, disable, or delete your account (or any part thereof) if we determine that you have violated any provision of this Agreement or that your conduct or content would tend to damage our reputation and goodwill.

If we delete your account for the foregoing reasons, you may not re-register for our Services.

Billing and payments

We charge monthly fee for subscription, see Pricing page for more information. Monthly credits expire at the end of the monthly billing period and do not roll over to the next month.

You can cancel your subscription any time you want. However, Enterprise plans require a minimum 30-day written notice prior to cancellation. Credits that you purchase must be used in 12 months after purchase, after which they expire. You need an active paid monthly plan to keep the credits and use our API. If you cancel your subscription, you will lose all remaining credits.

Digital Products and Download Access: All digital products, including but not limited to databases, datasets, software, and downloadable content offered through the Website and Services, are made available for download only after we have received full payment. Access to download links and digital product delivery is contingent upon successful payment processing and verification. You acknowledge and agree that no digital products will be released or made accessible until payment has been received and confirmed by Alpha Quantum.

User can only use the amount of credits specified under the plan information. The accuracy of our domains databases is in the range of 90% to 95% but can also deviate from this. Purchases for domains databases are not refunded.

Accuracy of information

Occasionally there may be information on the Website that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, availability, promotions and offers.

We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information on the Website or Services is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information on the Website including, without limitation, pricing information, except as required by law.

No specified update or refresh date applied on the Website should be taken to indicate that all information on the Website or Services has been modified or updated.

Links to other resources

Although the Website and Services may link to other resources (such as websites, mobile applications, etc.), we are not, directly or indirectly, implying any approval, association, sponsorship, endorsement, or affiliation with any linked resource, unless specifically stated herein.

We are not responsible for examining or evaluating, and we do not warrant the offerings of, any businesses or individuals or the content of their resources.

We do not assume any responsibility or liability for the actions, products, services, and content of any other third parties.

You should carefully review the legal statements and other conditions of use of any resource which you access through a link on the Website.

Your linking to any other off-site resources is at your own risk.

Competitor access prohibition

Definition of Competitor. For purposes of this Agreement, a "Competitor" means any individual, company, organization, or entity that offers, develops, operates, or is in the process of developing any product or service that is substantially similar to or competes with the Website and Services, including but not limited to: website categorization services, domain classification services, URL classification services, domain intelligence databases, internet domain databases, web filtering classification services, or any product or service that provides IAB taxonomy classification, content taxonomy classification, or domain-level metadata at scale.

Prohibition on Competitor Access. Competitors are strictly prohibited from accessing, registering for, subscribing to, or using the Website and Services in any capacity, including through trial accounts, free tiers, paid subscriptions, or any other means. This prohibition applies regardless of the stated or apparent purpose of access.

Prohibition on Access on Behalf of Competitors. You are prohibited from accessing the Website and Services on behalf of, at the direction of, or for the benefit of a Competitor, whether as an employee, contractor, consultant, agent, or in any other capacity.

Misrepresentation by Competitors. If a Competitor or representative of a Competitor registers for or accesses the Website and Services by misrepresenting their identity, organizational affiliation, or intended use case, such access constitutes a material breach of this Agreement and may constitute fraudulent misrepresentation under applicable law. Alpha Quantum reserves all rights and remedies available under EU law and this Agreement in such circumstances.

Contractual Penalty. In the event of a breach of this Section by a Competitor or by any person acting on behalf of a Competitor, the breaching party agrees to pay Alpha Quantum a contractual penalty in the amount of EUR 50,000 per breach, in addition to any other damages, losses, or costs incurred by Alpha Quantum as a result of such breach. The parties acknowledge that this amount represents a reasonable pre-estimate of the harm caused by unauthorized competitive access to Alpha Quantum's proprietary systems, data, and methodology. This contractual penalty shall be enforceable under applicable law, with exclusive jurisdiction in Ljubljana, Slovenia.

Registration and identity requirements

Accuracy of Registration Information. You represent and warrant that all information provided during registration and account creation is accurate, complete, and truthful, including your name, email address, company name, organizational affiliation, job title, and intended use case. Providing false, incomplete, or misleading registration information constitutes a material breach of this Agreement.

Prohibition on False Identity Registration. You are expressly prohibited from registering for or accessing the Website and Services using an anonymized email address, disposable email address, or any email address that is intended to conceal your true identity or organizational affiliation. You are further prohibited from using a personal email address where your actual employer or organizational affiliation is a Competitor as defined in this Agreement.

Authorized Representative Declaration. If you are registering on behalf of a company or other legal entity, you represent and warrant that: (i) you are duly authorized to bind that entity to this Agreement; (ii) the entity on whose behalf you are registering is not a Competitor as defined in this Agreement; and (iii) the intended use of the Website and Services is consistent with the permitted uses set forth in this Agreement. By completing registration, you accept personal liability for any breach of these representations.

Consequences of False Registration. Alpha Quantum reserves the right to immediately terminate any account where registration information is found to be false or misleading, without notice and without refund. Alpha Quantum further reserves the right to pursue all available legal remedies against individuals who obtained access through false registration, including claims for fraudulent misrepresentation under applicable law.

Data use restrictions and trade secrets

Permitted Use of Data. Data, results, outputs, and any other information obtained through the Website and Services may only be used for your own internal business purposes consistent with the intended use case declared at registration and permitted under this Agreement. Any other use requires the prior written consent of Alpha Quantum.

Prohibition on Use for Competing Products. You are strictly prohibited from using any data, results, outputs, categorization results, confidence scores, taxonomy assignments, or any other information obtained through the Website and Services, directly or indirectly, to: (i) develop, train, improve, validate, or benchmark any competing product or service; (ii) train or fine-tune any machine learning model, AI system, or classification algorithm intended for use in a competing product or service; (iii) create, compile, or supplement any database or dataset intended for use in a competing product or service; or (iv) inform any product, engineering, or strategic decision at a Competitor.

Trade Secrets. Alpha Quantum's categorization methodology, taxonomy mapping methodology, confidence scoring system, SNI classification logic, database compilation methodology, training data selection methodology, quality assurance processes, and any other non-public proprietary methods, systems, or processes embodied in or reflected by the Website and Services constitute trade secrets of Alpha Quantum within the meaning of EU Directive 2016/943 on the protection of undisclosed know-how and business information (trade secrets) as implemented in applicable law. Any access to the Website and Services for the purpose of obtaining insight into these trade secrets through improper means — including through covert access, false identity registration, or systematic querying designed to reverse-engineer proprietary methodology — constitutes misappropriation of trade secrets and may give rise to civil and criminal liability under applicable EU law, independently of any breach of this Agreement.

Prohibition on Resale and Redistribution. You may not resell, sublicense, redistribute, or otherwise transfer any data, results, or outputs obtained through the Website and Services to any third party without the prior written consent of Alpha Quantum, except as expressly permitted under your subscription plan.

Audit rights and account termination

Audit Rights. Alpha Quantum reserves the right to monitor, review, and audit usage patterns, API query patterns, account activity, and any other data associated with your use of the Website and Services at any time and without prior notice. This includes the right to use technical means including web analytics, access logs, query pattern analysis, and traffic monitoring to verify that your use of the Website and Services is consistent with the permitted uses set forth in this Agreement and with the intended use case declared at registration.

Cooperation with Audit. Upon request by Alpha Quantum, you agree to provide reasonable cooperation with any audit or investigation of your use of the Website and Services, including providing information about your organization, the identity of users accessing the Services under your account, and the purpose and nature of your use.

Right to Suspend or Terminate. Alpha Quantum reserves the right to immediately suspend or terminate your access to the Website and Services, without notice and without refund, if Alpha Quantum determines or reasonably suspects that: (i) your use is inconsistent with the permitted uses set forth in this Agreement; (ii) you have provided false registration information; (iii) you are a Competitor or are acting on behalf of a Competitor; (iv) your usage patterns suggest systematic data harvesting, reverse engineering, or competitive intelligence gathering; or (v) you have otherwise breached any provision of this Agreement.

Right to Refuse Service. Alpha Quantum reserves the right to refuse service, reject registrations, or cancel accounts at its sole discretion, including where Alpha Quantum has reason to believe that the applicant or account holder is a Competitor or is acting on behalf of a Competitor, without any obligation to provide reasons for such refusal.

Intellectual property rights

“Intellectual Property Rights” means all present and future rights conferred by statute, common law or equity in or in relation to any copyright and related rights, trademarks, designs, patents, inventions, goodwill and the right to sue for passing off, rights to inventions, rights to use, and all other intellectual property rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, rights to claim priority from, such rights and all similar or equivalent rights or forms of protection and any other results of intellectual activity which subsist or will subsist now or in the future in any part of the world.

This Agreement does not transfer to you any intellectual property owned by Alpha Quantum or third parties, and all rights, titles, and interests in and to such property will remain (as between the parties) solely with Alpha Quantum.

All trademarks, service marks, graphics and logos used in connection with the Website and Services, are trademarks or registered trademarks of Alpha Quantum or its licensors.

Other trademarks, service marks, graphics and logos used in connection with the Website and Services may be the trademarks of other third parties.

Your use of the Website and Services grants you no right or license to reproduce or otherwise use any of Alpha Quantum or third party trademarks.

Disclaimer of warranty

You agree that such Service is provided on an “as is” and “as available” basis and that your use of the Website and Services is solely at your own risk.

We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. We make no warranty that the Services will meet your requirements, or that the Service will be uninterrupted, timely, secure, or error-free; nor do we make any warranty as to the results that may be obtained from the use of the Service or as to the accuracy or reliability of any information obtained through the Service or that defects in the Service will be corrected.

You understand and agree that any material and/or data downloaded or otherwise obtained through the use of Service is done at your own discretion and risk and that you will be solely responsible for any damage or loss of data that results from the download of such material and/or data.

We make no warranty regarding any goods or services purchased or obtained through the Service or any transactions entered into through the Service unless stated otherwise. No advice or information, whether oral or written, obtained by you from us or through the Service shall create any warranty not expressly made herein.

Limitation of liability

To the fullest extent permitted by applicable law, in no event will Alpha Quantum, its affiliates, directors, officers, employees, agents, suppliers or licensors be liable to any person for any indirect, incidental, special, punitive, cover or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use of content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity) however caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise, even if the liable party has been advised as to the possibility of such damages or could have foreseen such damages. To the maximum extent permitted by applicable law, the aggregate liability of Alpha Quantum and its affiliates, officers, employees, agents, suppliers and licensors relating to the services will be limited to an amount no greater than one dollar or any amounts actually paid in cash by you to Alpha Quantum for the prior one month period prior to the first event or occurrence giving rise to such liability. The limitations and exclusions also apply if this remedy does not fully compensate you for any losses or fails of its essential purpose.

Indemnification

You agree to indemnify and hold Alpha Quantum and its affiliates, directors, officers, employees, agents, suppliers and licensors harmless from and against any liabilities, losses, damages or costs, including reasonable attorneys’ fees, incurred in connection with or arising from any third party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your Content, your use of the Website and Services or any willful misconduct on your part.

Severability

All rights and restrictions contained in this Agreement may be exercised and shall be applicable and binding only to the extent that they do not violate any applicable laws and are intended to be limited to the extent necessary so that they will not render this Agreement illegal, invalid or unenforceable. If any provision or portion of any provision of this Agreement shall be held to be illegal, invalid or unenforceable by a court of competent jurisdiction, it is the intention of the parties that the remaining provisions or portions thereof shall constitute their agreement with respect to the subject matter hereof, and all such remaining provisions or portions thereof shall remain in full force and effect.

Dispute resolution

The formation, interpretation, and performance of this Agreement and any disputes arising out of it shall be governed by applicable EU law without regard to rules on conflicts or choice of law. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the courts located in Ljubljana, Slovenia, and you hereby submit to the personal jurisdiction of such courts. You hereby waive any right to a jury trial in any proceeding arising out of or related to this Agreement. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.

Assignment

You may not assign, resell, sub-license or otherwise transfer or delegate any of your rights or obligations hereunder, in whole or in part, without our prior written consent, which consent shall be at our own sole discretion and without obligation; any such assignment or transfer shall be null and void. We are free to assign any of its rights or obligations hereunder, in whole or in part, to any third party as part of the sale of all or substantially all of its assets or stock or as part of a merger.

Changes and amendments

We reserve the right to modify this Agreement or its terms related to the Website and Services at any time at our discretion. When we do, we will revise the updated date at the bottom of this page. We may also provide notice to you in other ways at our discretion, such as through the contact information you have provided.

An updated version of this Agreement will be effective immediately upon the posting of the revised Agreement unless otherwise specified. Your continued use of the Website and Services after the effective date of the revised Agreement (or such other act specified at that time) will constitute your consent to those changes.

Acceptance of these terms

You acknowledge that you have read this Agreement and agree to all its terms and conditions. By accessing and using the Website and Services you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to access or use the Website and Services.

Supremacy of Terms: You expressly acknowledge and agree that by using the Website and Services, or by purchasing any products or services from Alpha Quantum, you accept and agree to be bound by these Terms of Service. In the event of any conflict, inconsistency, or contradiction between these Terms of Service and any other agreement, contract, purchase order, invoice, or legal document that Alpha Quantum may enter into with you or any third party in relation to our products, services, or operations, the terms and conditions set forth in these Terms of Service shall take precedence and prevail to the fullest extent permitted by applicable law. No provision in any subsequent agreement shall be deemed to supersede, modify, or waive any term of this Agreement unless explicitly stated in writing and duly executed by an authorized representative of Alpha Quantum.
